Terms of Service

These terms are an agreement between you and Stanislav Shelemekh, a sole proprietorship registered in Kraków, Poland, which runs BrightMind ("BrightMind", "we", "us"). By using the BrightMind app or website you accept them. Full business details are at the end of this page.

What BrightMind is

BrightMind is an AI assistant that helps you plan your day, get started on tasks and keep track of what matters, through text chat and voice calls. It can connect to task managers and calendars you choose. To use it you need a supported iPhone or Android device and an internet connection.

Who can use it

In the EU you must be at least 16, or have a parent's or guardian's consent. Elsewhere, you must be old enough under local law to agree to these terms, and never younger than 13.

Your account

The app creates an anonymous account for you, and you can choose to sign in with email, Apple or Google so you can recover it later. An anonymous account lives on your device: if you lose the device or sign out without signing in first, we may not be able to restore it. You are responsible for activity on your account and for keeping access to your device and sign-in method secure.

Using BrightMind fairly

Please don't:

  • use BrightMind for anything illegal, harmful, harassing or abusive;
  • try to break, overload or get around the security of the service;
  • scrape, copy or resell the service, or use it to build a competing product;
  • use automated means to create accounts or send requests;
  • share content you don't have the right to share.

Your content

What you write, say and upload stays yours. You give us permission to store and process it only as needed to run BrightMind for you, as described in our Privacy Policy.

When you connect another app, BrightMind can create, change, complete or delete items there when you ask it to. Those changes happen in your account with that service, so check the important ones.

AI answers and their limits

  • BrightMind's answers are generated by AI and can be wrong, incomplete or out of date. Check anything important before you rely on it.
  • BrightMind offers everyday planning and focus support. It is not medical, psychological, psychiatric, legal or financial advice, and it does not diagnose or treat any condition.
  • BrightMind is not a crisis service. If you are in danger or thinking about harming yourself, contact your local emergency number right away.

BrightMind Plus and payments

  • Some features need a BrightMind Plus subscription. The price, billing period and any free trial are shown in the app before you buy.
  • Subscriptions are sold and billed by Apple (App Store) or Google (Google Play). They renew automatically until you cancel, and a free trial becomes a paid subscription unless you cancel before it ends.
  • Cancel in your App Store or Google Play account settings. Deleting your BrightMind account does not cancel the subscription.
  • Refunds are handled by Apple or Google under their policies. Your rights as a consumer under the law, including any right of withdrawal, are not affected.

Other services

BrightMind works with services run by others, such as the app stores and the task managers and calendars you connect. Their own terms apply to your use of them, and we are not responsible for how they work or for changes they make.

Changes to BrightMind and to these terms

BrightMind is growing, so features will change and some may be removed. When we change these terms, we update the date at the top, and for significant changes we give notice in the app or on this page before they take effect. If you don't agree with a change, you can stop using BrightMind and delete your account.

Ending your use of BrightMind

You can stop using BrightMind and delete your account at any time from Settings or at brightmind.club/delete-account. We may suspend or close an account that breaks these terms or puts other users or the service at risk. If we ever shut BrightMind down, we will give you reasonable notice.

Warranties and liability

BrightMind is provided "as is". We work hard to keep it reliable, but we can't promise it will always be available, error-free or right for your needs.

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to €50 or the amount you paid us in the 12 months before the claim, whichever is greater. None of this limits liability for harm caused intentionally or through gross negligence, or any consumer rights you have under mandatory law.

Complaints, law and disputes

If something isn't working or you want to complain, email stan@brightmind.club. We reply within 14 days.

These terms are governed by Polish law, and disputes go to the courts of Kraków. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and can also bring a claim in your local courts.
